According to sensorimotor theory perceiving is a bodily skill involving exercise of an implicit know-how of the systematic ways that sensations change as a result of potential movements, that is, of sensorimotor contingencies. The theory has been most successfully applied to vision and touch, while perceptual modalities that rely less on overt exploration of the environment have not received as much attention. In addition, most research has focused on philosophically grounding the theory and on psychologically elucidating sensorimotor laws, but the (...) theory’s ramifications for neuroscience still remain underexamined. Here we sketch the beginnings of a research program that could address these two outstanding challenges in terms of auditory perception. We review the neuroscience literature on passive listening, which is defined as listening without overt bodily movement, and conclude that sensorimotor theory provides a unique perspective on the consistent finding of motor system activation. In contrast to competing theories, this activation is predicted to be involved not only in the perception of speech- and action-related sounds, but in auditory perception in general. More specifically, we propose that the auditory processing associated with supplementary motor areas forms part of the neural basis of the exercise of sensorimotor know-how: these areas’ recognized role in facilitating spontaneous motor responses to sound and supporting flexible engagement of sensorimotor processes to guide auditory experience and enable auditory imagery, can be understood in terms of two key characteristics of sensorimotor interaction, its “alerting capacity” and “corporality”, respectively. We also highlight that there is more to the inside of the body than the brain: there is an opportunity to develop sensorimotor theory into new directions in terms of the still poorly understood active processes of the peripheral auditory system. Este artículo explora la gestualidad multisensorial, háptica y motriz como forma de habitar las atmósferas. Contribuye al desarrollo de epistemologías relacionales sobre la dimensión corporal, al abordar la experiencia corporeizada vivida con entornos aéreos, materiales, ecológicos y sociales, en lugar de centrarse en el significado conceptual y semántico para su explicación. El marco conceptual, se basa en la teoría de las affordances, las ciencias cognitivas enactivas y la fenomenología, que ofrecen una vía para configurar la interacción piel-atmósfera. Consideramos la unidad (...) organismo-entorno y lo que en la literatura se identifica con el concepto de atmósfera sonora. Se introduce la noción de affordances multisensoriales y hápticas como encuentro sensual y atencional de la presencia, para argumentar que tanto el enfoque contemporáneo del cuerpo háptico y gestual con posibilidades afectivas y de movimiento, como la perspectiva estética y ecológico-social de la performatividad -aunque conceptualmente útiles-, pasan por alto la existencia de una fenomenología háptica del reino sensual de las atmósferas. Así, se describe el entrelazamiento de las experiencias sensibles y estéticas con territorios sonoros habitados desde la experiencia táctil. Se discute cómo lo sonoro y la materialidad se utilizan para vivir experiencias particulares del espacio dentro de uno específico: la instalación arpa de fricción. Finalmente, con base en la distinción entre la sensibilidad y la consciencia, se orienta hacia una pedagogía de experiencias háptico-sonoras durante procesos de aprendizaje, útil en contextos de educación corporeizada, estética y crítica. Y se ofrece un lugar para imaginar y escenificar este tipo de entornos de aprendizaje de una manera deliberada, con cualidades permeables, inmersivas, afectivas y colectivas, para acompañar en la co-creación de mundos alternativos. Welcoming Hug’s critical analysis of educational and pedagogical applications of 4E cognition, I discuss the relevance of considering some enactive perspectives in dialogue with Freirean critical pedagogy in order to advance his proposal.

The aim of this paper is to provide a theoretical and formal framework to understand how the proprioceptive and kinesthetic system learns about body position and possibilities for movement in ongoing action and interaction. Whereas most weak embodiment accounts of proprioception focus on positionalist descriptions or on its role as a source of parameters for internal motor control, we argue that these aspects are insufficient to understand how proprioception is integrated into an active organized system in continuous and dynamic interaction (...) with the environment. Our strong embodiment thesis is that one of the main theoretical principles to understand proprioception, as a perceptual experience within concrete situations, is the coupling with kinesthesia and its relational constitution—self, ecological, and social. In our view, these aspects are underdeveloped in current accounts, and an enactive sensorimotor theory enriched with phenomenological descriptions may provide an alternative path toward explaining this skilled experience. Following O'Regan and Noë sensorimotor contingencies conceptualization, we introduce three distinct notions of proprioceptive kinesthetic-sensorimotor contingencies, which we describe conceptually and formally considering three varieties of perceptual experience in action: PK-SMCs-self, PK-SMCs-self-environment, and PK-SMC-self-other. As a proof of concept of our proposal, we developed a minimal PK model to discuss these elements in detail and show their explanatory value as important guides to understand the proprioceptive/kinesthetic system. Finally, we also highlight that there is an opportunity to develop enactive sensorimotor theory in new directions, creating a bridge between the varieties of experiences of oneself and learning skills. The main goal of this commentary is to provide an impetus toward the integration of some aspects of musical enactivism and ecological psychology into the framework of the semiotic eigencycle. I argue that the notions of embodied imagination and musical affordances at the level of interaction between agent and musical environment, play a robustly causal or perhaps even a constitutive role in the music cognitive semiotic process.

In this paper, we introduce a dialogue between (post-)phenomenological and decolonial approaches to propose a sentipensante ethics. Emancipating from hegemonic approaches to ethics that privilege rationality over feeling bodies, we conceptualise an analogical ethics of virtues that emerge in the framework of an analectic-responsive experience. In this experience, we specify the affective, interoceptive, and inter-bodily aspects as elements of a sentipensante ethics from an enactivist perspective. This exercise allows us to highlight the foundation of the ethical experience as a participatory (...) virtue-making oriented towards solidary well-being. Finally, it invites us to search for pedagogical practices that cultivate this virtue-making. En este artículo introducimos un diálogo entre enfoques (post-)fenomenológicos y decoloniales para proponer una ética sentipensante. Nos emancipamos de perspectivas hegemónicas que privilegian la racionalidad sobre los cuerpos que sienten, y conceptualizamos una ética analógica de virtudes que emergen en el marco de una experiencia responsiva analéctica. De esta experiencia, precisamos los aspectos afectivos, interoceptivos, e inter-corporales, como elementos de una ética sentipensante desde una perspectiva enactivista. Este ejercicio nos permite resaltar el fundamento de la experiencia ética como un hacer-virtud participativo orientado hacia el bienestar solidario. Open peer commentary on the article “Never Mind the Gap: Neurophenomenology, Radical Enactivism, and the Hard Problem of Consciousness” by Michael D. Kirchhoff & Daniel D. Hutto. Upshot: Kirchhoff and Hutto argue that the metaphysical commitments of neurophenomenology, as formulated by Varela in 1996, endorse a form of non-reductionism, which assumes and does not resolve the hard problem of consciousness. Although I share Kirchhoff and Hutto’s conceptual concern, I disagree that denying the gap between the phenomenal and the physical, opting (...) for an identity theory in a radical enactivism framework, is a promising alternative to a better understanding of human experience. Resumen Valparaíso es un ejemplo paradigmático de las crisis e inestabilidades del capitalismo y de la modernización latinoamericana durante los siglos XIX y XX. Su historia de riqueza, segregación, cosmopolitismo y decadencia, se proyecta en la escritura respecto de la ciudad, que problematizamos a partir de los conceptos de desterritorialización y extrañamiento, ya que percibimos una presencia importante de autores extranjeros y afuerinos en la producción literaria porteña. Para analizar la elaboración textual de unas subjetividades cuyos referentes y marcos culturales (...) se tensionan en Valparaíso, proponemos siete períodos: 1) de los viajeros ilustrados; 2) de los debates fundacionales; 3) del modernismo y la poesía social; 4) de las vanguardias expresionista e imaginista; 5) de la novela social; 6) de la novela del aprovinciamiento; 7) y de la poesía del exilio, en que el proceso se invierte y algunos poetas porteños escriben acerca de Valparaíso en el extranjero.Valparaíso is a paradigmatic example of Capitalism's crisis and instabilities and of Latin American modernization during the XIX and XX centuries. Its history of wealth, segregation, cosmopolitism, and decadence is projected in the writings about the city, which we problematize based on the concepts of deterritorialization and alienation, since we perceive a significant presence of foreign and outsider authors in the literary production of Valparaíso. To analyze the textual elaboration of some subjectivities whose points of reference and cultural frameworks are tensioned in Valparaíso, we propose seven periods: 1) the enlightenment travellers; 2) the foundational debates; 3) modernism and social poetry; 4) the expressionist and imaginist vanguards; 5) the social novel; 6) the provincial novel; 7) and the poetry of exile, where the process reverses and some local poets write about Valparaíso while overseas. In the target article, Sagvolden and collaborators propose that attentional-deficit/hyperactivity disorder (ADHD) is the result of a general behavioral deficit which is mainly caused by a hypofunctioning mesolimbic dopaminergic system. Although we partly agree with this view, we think that it tends to overlook the dysfunction of prefrontal and frontostriatal executive functions by considering them to be a consequence of alterations in reward and extinction mechanisms. Rather, we believe that ADHD is the result of an overall cognitive and behavioral condition, (...) associated to a generalized dopaminergic network dysfunction, and may not be easily attributable to a single basic behavioral function. A pesar de su singular condición urbana, de su atractivo internacional, y de ser la segunda ciudad en importancia de Chile, Valparaíso no cuenta con una suficiente historiografía de su pasado urbano. Este artículo pretende ser un aporte a ella, teniendo a los cerros como protagonistas, para estudiar su la etapa inicial de poblamiento. Se centra en el proceso en que se fueron instalando viviendas - que constituyeron una fisonomía urbana particular, además de barrios-, en los distintos cerros de Valparaíso, (...) diferenciando etapas tanto en alturas como en cerros. Se pone especial atención, también, en los tipos de viviendas pobres y serranas de esa época y, finalmente, en las conclusiones, se plantean algunos problemas de investigación futura, relativos al urbanismo histórico de los cerros de Valparaíso. Frente a un proceso histórico de larga data inscrito en las transformaciones de la familia, el final del siglo pasado ha visto declinar la autoridad paterna propia de la matriz familiar patriarcal y moderno-industrial, abriendo un nuevo lugar al padre. Sobre la base de treinta entrevistas, este artículo analiza los cambios en las representaciones de la paternidad en distintos grupos sociales chilenos, las rupturas intergeneracionales y los modelos de paternidad contemporáneos, poniendo en evidencia los límites del cambio del orden de (...) género tradicional aunque los padres actuales se muestren más involucrados y cercanos a sus hijos en un contexto en que convive el padre moderno con el “amo” que gobierna la familia restaurando la tradición. El objetivo de este estudio es determinar la relación entre las habilidades psicolingüísticas y el rendimiento escolar. El presente estudio es cuantitativo, descriptivo correlacional, transversal no experimental. La muestra estuvo compuesta por 35 estudiantes de 4° año de un colegio particular subvencionado de Chillán, Chile. La recolección de datos se obtuvo mediante la aplicación del Test de Illinois de Aptitudes Psicolingüísticas y el promedio final de las asignaturas de Lenguaje, Matemáticas, Ciencias Sociales e Historia y Geografía. The objective of this research is to develop accurate forecasting models for chlorophyll-α concentrations at various depths in El Mar Menor, Spain. Chlorophyll-α plays a crucial role in assessing eutrophication in this vulnerable ecosystem. To achieve this objective, various deep learning forecasting techniques, including long short-term memory, bidirectional long short-term memory and gated recurrent uni networks, were utilized. The models were designed to forecast the chlorophyll-α levels with a 2-week prediction horizon. To enhance the models’ accuracy, a sliding window method (...) combined with a blocked cross-validation procedure for time series was also applied to these techniques. Two input strategies were also tested in this approach: using only chlorophyll-α time series and incorporating exogenous variables. The proposed approach significantly improved the accuracy of the predictive models, no matter the forecasting technique employed. Results were remarkable, with |$\overline{\sigma}$| values reaching approximately 0.90 for the 0.5-m depth level and 0.80 for deeper levels. The proposed forecasting models and methodologies have great potential for predicting eutrophication episodes and acting as decision-making tools for environmental agencies. Accurate prediction of eutrophication episodes through these models could allow for proactive measures to be implemented, resulting in improved environmental management and the preservation of the ecosystem. Postulo una lectura de la poesía chilena que tiene como objetivo poner de relieve un nuevo protocolo de interpretación, entendimiento y desciframiento de las claves que vinculan al creador, al lector, a la sociedad y a la cultura con el entorno ambiental.

Se è spontaneo associare i concetti di immagine e immaginario, in quanto sembrano due nozioni strettamente legate, non è affatto semplice determinare il modo in cui si configura il loro rapporto. Per tracciare i distingua di tale relazione e i metodi che possono aiutarci a chiarirla, partiremo dalla descrizione della coscienza d’immagine — si tratta di un termine husserliano — per arrivare al mito. La nostra riflessione si dividerà in diversi fasi. Analizzeremo infatti la struttura fenomenica dell’immagine mentale, del segno (...) e del simbolo e seguiremo, brevemente, anche il cammino inverso che va dal simbolo all’immagine. I punti salienti della nostra dimostrazione saranno i seguenti: il rapporto immagine-immaginario non può essere definito in modo univoco, in quanto cambia in base al tipo di immagine; a livello della coscienza d’immagine, un approccio psicologico può rivelarsi utile, poiché il supporto percettivo costituisce un momento essenziale dell’immagine reale; nel caso della phantasia o immagine mentale, il metodo psicoanalitico sembra quello più appropriato, poiché l’assenza del supporto percettivo rende le immagini mentali libere da ogni costrizione. Pertanto la comprensione delle dinamiche affettive-desiranti può fornire una spiegazione al corso apparentemente sregolato di associazioni che qui si manifestano. Per quanto riguarda il segno, il simbolo e il mito, le dimensioni affettiva, percettiva, transizionale e fantastica sono strettamente correlate. Questo tipo di immagini sembrano insistere su “schermi” diversi e pertanto si richiede un approccio metodologico variegato. (shrink)

Aux États-Unis, les évangéliques blancs ont massivement soutenu Donal Trump aux élections de 2016 et 2020, dont le projet politique était clairement associé à un nationalisme chrétien, promoteur des valeurs du suprémacisme blanc. Cet article propose de rappeler les faits en se plaçant depuis la perspective de baptistes opposés à l’extrême-droite chrétienne, en revenant sur le sur le cas du Baptist Joint Committee for Religious Liberty (BJC) qui, appuyé par plusieurs figures de militants évangéliques, fait activement campagne pour dénoncer les (...) dérives de ce christianisme suprémaciste et ses dangers pour la démocratie. Cependant, malgré sa médiatisation et ses relais politiques, son influence demeure restreinte au sein de la mouvance évangélique elle-même. (shrink)

The world's population is currently overcoming one of the worst pandemics, and the psychological and social effects of this are becoming more apparent. We will present an analysis of the psychosocial effects of COVID-19: first, a cross-sectional study in an Ecuadorian sample and second, a comparative study between two samples from the Ecuadorian and Spanish populations. Participants completed an online survey to describe how they felt before and after confinement; analyze which emotional and behavioral variables predict depressive symptoms, anxiety, and (...) stress perceived after the confinement; carry out a comparative study in a sample of Ecuadorian and Spanish surveys. Results indicate, first, that Ecuadorians experience significantly more depressive symptoms, anxiety, and stress after confinement. Second, variables which predict depressive symptoms and anxiety are greater public prosocial tendency, less stress as a challenge, and greater stress as a threat, as well as an empathetic tendency that implies greater emotional regulation. Experienced stress after confinement was predicted by a greater public prosocial tendency, as well as an empathetic tendency. Finally, scores for depression, anxiety, and stress are higher after confinement in both countries. However, results reveal the similarity of the psychosocial effects that are being experienced, regardless of the country, and the differences in the variables that can help explain these effects. This can contribute to the constitution of intervention plans which aim to soften and alleviate the effects produced by a situation such as that experienced with COVID-19. (shrink)

Resumen: Esta investigación busca dar cuenta de los espacios que habitan los personajes del cuento Alegres, libres y ruidosas de Pedro Juan Gutiérrez. Mediante los detalles que nos entrega el narrador, revisaremos los “operadores tonales”, estableciendo los enunciados descriptivos y los detalles inherentes a ellos, en cuanto a la composición de los personajes, así como el tipo de espacio en que se realizan, construyendo una identidad transgresora bajo la perspectiva de la poética de lo soez. En este sentido, los personajes (...) serán “máquinas deseantes” que irrumpen en la realidad con un flujo sistemático de líquidos descompuestos que arrastran residuos políticos, éticos y estéticos presentes en la Cuba contemporánea. Así, podríamos hablar de un sexo eminentemente político que no se presenta denotativamente en el cuento sino en las metáforas construidas por aquellos operadores que fijan el “tono” del relato. Por último, postulamos que los detalles funcionan como “pistas” de una historia secreta que funciona bajo la historia visible que se narra en el cuento.: This research seeks to explain the spaces inhabited by characters from the story Alegres, libres y ruidosas by Pedro Juan Gutiérrez. Thoughout the details provided by the narrator, we will review “tone operators”, determining their descriptive and inherent statements, concerning characters, the space in which they are realized by building a transgressor identity under the view poetics of the vulgar. In this sense, the characters are "desiring machines" that burst into reality with a systematic flow of decomposed liquids that drag political, ethical and aesthetic residues present in contemporary Cuba. Thus, we could speak of an eminently political sex that does not occur denotatively in the story but in the metaphors constructed by those operators who fix the "tone" of the story. Finally, we postulate that the details function as "clues" of a secret story that works under the visible story told in the tale. (shrink)

Long-term ecological research (LTER), addressing problems that encompass decadal or longer time frames, began as a formal term and program in the United States in 1980. While long-term ecological studies and observation began as early as the 1400s and 1800s in Asia and Europe, respectively, the long-term approach was not formalized until the establishment of the U.S. long-term ecological research programs. These programs permitted ecosystem-level experiments and cross-site comparisons that led to insights into the biosphere’s structure and function. The holistic (...) ecosystem approach of this initiative also allowed the incorporation of the human-dimension of ecology and recently has given rise to a new concept of long-term socio-ecological research (LTSER). Today, long-term ecological research programs exist in at least thirty-two countries (i.e., members of the International Long-Term Ecological Research Network, ILTER). However, consolidation of the international network within the long-term socio-ecological research paradigm still requires: (1) inclusion of certain remote regions of the world, such as southwestern South America, that are still poorly represented; (2) modifications of the type of research conducted, such as integrating social and natural sciences with the humanities and ethics; and (3) the incorporation of findings and results into broader social and political processes. In this context, a nascent long-term socio-ecological research network in Chile, which extends over the longest latitudinal range of temperate forest in the Southern Hemisphere, adds a new remote region to international long-term ecological research previously overlooked. In addition, collaboration with the University of North Texas and other international partners helps to further develop an interdisciplinary approach for the integration of the ecological sciences and environmental philosophy together with traditional ecological knowledge, informal and formal education, policy, the humanities, socio-political processes, and biocultural conservation. The relation between Wittgenstein's philosophy of mathematics and mathematical Intuitionism has raised a considerable debate. My attempt is to analyse if there is a commitment in Wittgenstein to themes characteristic of the intuitionist movement in Mathematics and if that commitment is one important strain that runs through his Remarks on the foundations of mathematics. The intuitionistic themes to analyse in his philosophy of mathematics are: firstly, his attacks on the unrestricted use of the Law of Excluded Middle; secondly, his distrust (...) of non-constructive proofs; and thirdly, his impatience with the idea that mathematics stands in need of a foundation. These elements are Fogelin's starting point for the systematic reconstruction of Wittgenstein's conception of mathematics. (shrink)

In the present paper we address the problem of optical isomerism embodied in the socalled “Hund’s paradox”, which points to the difficulty to account for chirality by means of quantum mechanics. In particular, we explain the answer to the problem proposed by the theory of decoherence. The purpose of this article is to challenge this answer on the basis of a conceptual analysis of the phenomenon of decoherence, that reveals the limitations of the theory of decoherence to solve the difficulties (...) posed by optical isomerism and, in general, by quantum measurement. A partir de una concepción desprejuiciada respecto de lo marginal, de la fealdad y la miseria, el autor despliega una mirada alterna sobre los espacios de borde en busca de la reivindicación de la miseria, a la vez que relativizar el canon estético que prestigia temas y motivos (...) lejanos al campo de referencia de quienes habitan el borde. La exhibición de aquellos espacios, los personajes y los paisajes minoritarios, su composición plástica y narrativa, sin embargo, dialogan permanentemente con la tradición pictórica de elite. La exhibición de aquellos espacios, los personajes y los paisajes minoritarios, su composición plástica y narrativa, sin embargo, dialogan permanentemente con la tradición pictórica de elite.: The present work seeks to reflect, from the perspective of interartistic studies, on the narrative practice of Adolfo Couve, Chilean writer and painter who thematizes the plastic world in all his narrative production. Starting from an unprejudiced conception regarding the marginal, the ugliness and the misery, our author displays an alternate look on the edge spaces in search of the vindication of the misery, at the same time that relativizes the aesthetic canon that prestige subjects and reasons far from the reference field of those who inhabit the edge. La comprensión y el análisis del problema de la intersubjetividad y la experiencia del otro ha sido un ámbito controvertido para la fenomenología en general, y no es excepción en la fenomenología de la vida de Michel Henry. La fenomenología henryana presenta como núcleo de su reflexión la subjetividad, que es concebida como realidad encarnada, una realidad afectiva y fundamentalmente viviente, cuya praxis se expresa en el trabajo subjetivo viviente. Desde este punto de partida filosófico, la alteridad, la intersubjetividad y (...) la comunidad sólo son posibles para Henry desde la afectividad, que es concebida como el único horizonte de la manifestación, ya no de la subjetividad solamente, sino de toda manifestación posible, es decir, como esencia de la manifestación. Our purpose in this essay is to introduce new concepts in a wide and recursive view of the systemic consequences of the following biological facts that I and we have presented that can be resumed as: that as living systems we human beings are molecular autopoietic system; that living systems live only as long as they find themselves in a medium that provides them with all the conditions that make the realization of their living possible, that is, in the continuous (...) conservation of their relation of adaptation to the circumstances in which they find themselves; that as a living system exists only in a relation of adaptation with the medium that operates as its ecological niche, its reproduction necessarily occurs as a process of systemic duplication or multiplication of the ecological organism-niche unity that it integrates; that the worlds of doings that we generate as languaging beings in our conversations, explanations, reflections and theories are part of our ecological niche; and that we human beings as living beings that exist in languaging, are biological–cultural beings in which our cultural and our biological manners of existences can be distinguished but cannot be separated. Of the systemic consequences of these biological facts that we consider in this essay, we wish to mention two as the principal: that the diversification of manners of living produced in biological evolution is the result of differential survival in a changing medium through the conservation of adaptation, and not through competitive survival of the best; and that we in our living as languaging human beings are the epistemological fundament of all that we do and know as such. Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Francez has suggested that connexivity can be predicated of connectives other than the conditional, in particular conjunction and disjunction. Since connexivity is not any connection between antecedents and consequents—there might be other connections among them, such as relevance—, my question here is whether Francez’s conjunction and disjunction can properly be called ‘connexive’. I analyze three ways in which those connectives may somehow inherit connexivity from the conditional by standing in certain relations to it. I will show that Francez’s connectives fail (...) all these three ways, and that even other connectives obtained by following more closely Wansing’s method to get a connexive conditional, fail to be connexive as well. Background:The decision whether to initiate cardiopulmonary resuscitation may sometimes be ethically complex. While studies have addressed some of these issues, along with the role of nurses in cardiopulmonary resuscitation, most have not considered the importance of nurses acting as advocates for their patients with respect to cardiopulmonary resuscitation.Research objective:To explore what the nurse’s advocacy role is in cardiopulmonary resuscitation from the perspective of patients, relatives, and health professionals in the Basque Country (Spain).Research design:An exploratory critical qualitative study was conducted from (...) October 2015 to March 2016. Thematic analysis was used to analyse the data.Participants:Four discussion groups were held: one with patients and relatives (n = 8), two with nurses (n = 7 and n = 6, respectively), and one with physicians (n = 5).Ethical considerations:Approval was obtained from the Basque Country Clinical Research Ethics Committee.Findings:Three significant themes were identified: (a) accompanying patients during end of life in a context of medical dominance, (b) maintaining the pact of silence, and (c) yielding to legal uncertainty and concerns.Discussion:The values and beliefs of the actors involved, as well as pre-established social and institutional rules reduced nurses’ advocacy to that of intermediaries between the physician and the family within the hospital environment. On the contrary, in primary health care, nurses participated more actively within the interdisciplinary team.Conclusion:This study provides key information for the improvement and empowerment for ethical nursing practice in a cardiac arrest, and provides the perspective of patients and relatives, nurses and physicians. En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga.
